This policy also sets out the terms between you and us under which you may use the EmCan Mobile App or Website/access promotion/purchase goods, in each case, as provided by us (the EmCan Mobile App or Website). By using or accessing the EmCan Mobile App or Website, you accept and consent to the practices described in this policy. Your use or access of the EmCan Mobile App or Website means that you accept, and agree to abide by, all the policies herein, which supplement our relevant terms of use. 

1. Information we collect from you:   

1.1 We will collect and process the following data about you: 

a. Information you give us. This is information about you that you give us through your use or access to the EmCan Mobile App or Website or by corresponding with us by e-mail or otherwise. The information you give us may include your name, address, company name, e-mail address, phone number, personal description, photograph, or any other information. 

b. Information we collect about you. Regard to each time you use or access the EmCan Mobile App or Website, we will automatically collect the following information: 

b.1 technical information, including the Internet protocol address used to connect your computer to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system, and platform.

b.2 Information about your visit, including the full Uniform Resource Locators (URL), clickstream to, through, and from our digital platforms (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number. 

b.3 Identifiers such as Device ID to enhance your user experience through personalized content and notifications. The collected identifiers will never be shared with third parties, their collection is only meant to improve your satisfaction and interaction with EmCan.

b.4 Background Location: EmCan may track your location even when the EmCan App is not in use to provide you with geofencing push notifications and enhance your user experience. Geofencing push notifications are personalized alerts and messages sent to your device when you enter or exit an Emarat station that offers discounts or promotions relevant to you.

We track your location to: 

  • Send you relevant and timely notifications based on your location. 

  • Improve the accuracy and effectiveness of our services. 

  • Provide you with location-based features and content.

b.4.3 Opting Out: 

  • You have the option to disable location services for EmCan in your device settings, which will prevent us from collecting your background location data. However, disabling location services may prevent us from notifying you about offers, discounts or promotions that Emarat stations may propose.

b.4.4 Third-Party Access: 

  • We may share your location data with third-party service providers who assist us in delivering geofencing push notifications and related services. These third parties are bound by confidentiality agreements and are prohibited from using your location data for any other purpose.

 b.4.5 Data Retention

We retain your background location data for as long as necessary to fulfill the purposes outlined in        this policy. You can request the deletion of your location data by contacting us at info@emcan.com 

c.  Information we receive from other sources. This is the information we receive about you if you use any of the other websites we operate or the other services we provide, we are working closely with third parties (including, for example, business partners, and sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies). 

d. Cookies. We use cookies to distinguish you from other users. This helps us to provide you with a good experience when you visit us. 

e. By using or accessing the EmCan Mobile App or Website, you consent to the collection, use and storage of your personal information as set out herein. 

 

2. Uses made of the information 

2.1 We use information held about you in accordance with the relevant terms governing the EmCan Mobile App or Website and (this list is not exhaustive but for mere indication and explanation purposes): 

a. To provide you, or permit selected third parties to provide you, with information about goods or services we feel may interest you. If you do not want us to use your data in this way or to pass your details on to third parties for marketing purposes, please tell us; 

b. To notify you about changes to our services; 

c. To ensure that content from the EmCan Mobile App or Website is presented most effectively for you and for your device; 

d. To administer the EmCan Mobile App or Website and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes; 

e. To improve the EmCan Mobile App or Website to ensure that content is presented most effectively for you and for your device; 

f. To allow you to participate in interactive features of the EmCan Mobile App or Website when you choose to do so; 

g. To measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you; and 

h. To make suggestions and recommendations to you and other users of the EmCan Mobile App or Website about goods or services that may interest you or them. 

3. Disclosure of your information 

3.1 You agree that we have the right to share your information (both technical and personal) with: 

a. Any member of our group, which means our subsidiaries, our ultimate holding company, and its subsidiaries; 

b. Selected third parties including (this list is not exhaustive):

3.2 analytics and search engine providers that assist us in the improvement and optimization of the EmCan Mobile App or Website. 

3.3 If we are under a duty to disclose or share your personal data to comply with any legal or audit obligation, or to enforce or apply the terms governing the EmCan Mobile App or Website and other agreements, or to protect our rights, property, or safety, our customers, or others or in relation to information security breach investigation and/or notification. This includes exchanging information with other companies and organizations for the purposes of fraud protection or risk control or for any legal or regulatory purpose. 

4. Where we store your personal data 

4.1 The data that we collect from you may usually be stored in the United Kingdom, but we may transfer, store or process it in the UAE or other jurisdictions. By submitting your personal data, you agree to this transfer, storing, or processing either within or outside of the UAE. We will take all steps reasonably practicable to ensure that your data is treated securely and in accordance with this privacy policy. If you do not consent to your data being stored outside of the UAE, you can exercise your right to prevent such storage by notifying us in writing as soon as you start using EmCaan Mobile App or Website. 

4.2 We use information held about you in accordance with the relevant terms governing the EmCan Mobile App or Website and (this list is not exhaustive): 

4.3 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to any digital platform used for the EmCan Mobile App or Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

5. Use of Face ID for iOS Device Login: EmCan offers the option to log in using Face ID, a facial recognition technology provided by Apple Inc. This feature is available on compatible iOS devices equipped with Face ID functionality. 

5.1 How Face ID Works: 

  • Face ID scans and analyzes your facial features to securely authenticate your identity for logging into EmCan. Your facial data is processed locally on your device and is not transmitted to our servers. 

5.2 Data Collected and Stored: 

  • When you choose to use Face ID for login, we do not collect or store any facial recognition data. Apple's Face ID technology manages and secures your facial data within the device's hardware and software. 

5.3 Purpose of Face ID Usage: 

  • We use Face ID solely for the purpose of enhancing the security and convenience of your login experience. It provides a secure and efficient method of authentication, reducing the need for entering passwords. 

6. Your rights 

      6.1 You have the right to ask us to process your personal data for marketing purposes. you can exercise your right to prevent such processing by notifying us at email info@emcan.com. You may also withdraw your consent at any time and request that we delete your personal data by contacting email info@emcan.com nevertheless, this may impact your access to the EmCan Mobile App or Website. 

      6.2 The EmCan Mobile App or Website may, from time to time, contain links to and from the websites or apps of our partner networks, advertisers, and affiliates. If you follow a link to any of these websites or apps, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies or any technical bugs or malfunctions that may be caused by our partners networks. Please check these policies before submitting personal data to these websites or apps. 

 

7. Changes to our privacy policy 

7.1 We reserve the right to change this privacy policy from time to time, and your continued use of the EmCan Mobile App or Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether this privacy policy has been changed.

8. Dispute resolution policy 

8.1 The applicable laws the United Arab Emirates govern this privacy policy, its subject matter, and its formation. The Federal Courts of Abu Dhabi will have exclusive jurisdiction on matter or dispute that may arise in relation to this privacy policy or your use to EmCan Mobile App or Website.
